Abstract -
Loyalty rebates have a contentious place in competition law since they can both produce real efficiency and prevent competitors from accessing the market. This research paper tracks the transition from formalistic assumptions to effects-based scrutiny by analysing how these schemes are handled in India, the US, and the EU. Through comparative US-EU jurisprudence and doctrinal analysis of CCI v. Schott Glass, the article makes the case that thorough, evidence-driven evaluation, as opposed to categorical condemnation, is the most effective way to differentiate between exclusionary behaviour and normal business behaviour.
