Abstract

The Uniform Civil Code (UCC) is an important constitutional issue concerning equality, gender justice, religious freedom and individual rights in India. This article examines the historical development of personal laws, the Constituent Assembly debates and the constitutional basis of the UCC under Article 44. It also analyses important Supreme Court decisions, including Shah Bano, Sarla Mudgal, John Vallamattom, Shayara Bano and Shabnam Hashmi. The article further examines the Uniform Civil Code Bill, 2019 and recent developments in Uttarakhand and other States. It highlights the challenges of achieving uniformity while respecting India's religious and cultural diversity. The study concludes that UCC reform requires a careful balance between equality, individual rights, religious freedom and constitutional values.
