Abstract

Any disagreement in the world needs an impartial third party to mediate a settlement between them. What occurs when two nations disagree over a trade issue? Who will foresee these discussions? At that point, an independent body known as the World Trade Organisation (WTO) takes over. The WTO plays a central role in regulating International trade disputes through its Dispute Settlement Understanding (DSU), which is often described as the backbone of multilateral trading system. This project seeks to examine the legal and strategic implications of the WTO dispute settlement mechanism and its influence on the global market competition and International business behaviour. It also aims to bridge legal analysis under Competition Law with managerial and strategic perspectives from international business studies.   The study analyses how WTO rulings address anti-competitive practices such as unjust subsidies and discriminatory tariffs, highlighting fundamental principles including Most-Favoured-Nation treatment and National Treatment to promote equitable international trade. It assesses the efficacy of the WTO Appellate Body in light of recent challenges. The study employs secondary sources to analyse important disputes, such as the Boeing–Airbus disagreement, US-China disputes, evaluating legal arguments and their economic ramifications for multinational firms.   The conclusion presents guidelines for firms to manage regulatory risks and suggests improvements to improve the WTO's dispute resolution system, highlighting its continued importance in global market competition.
