Abstract

Compulsory mining corporate social responsibility in Tanzania Mainland rests on an identifiable statutory duty. The difficulty lies in connecting that duty with decisions that companies, public authorities and communities can understand and question. This article examines regulatory clarity, coherence and international alignment through doctrinal and documentary analysis informed by qualitative interviews conducted in 2026. Section 136 of the Mining Act, local government involvement, and extractive-sector reporting provide a substantial foundation. Uncertainty persists over the status and revision of plans, the relationship between institutional powers, and beneficiaries’ access to information and remedies. The High Court’s decision in Kegoye illustrates why detailed subsidiary rules must remain consistent with their enabling legislation. A comparison with selected international instruments reveals both useful domestic arrangements and incomplete connections between participation, disclosure, and accountability. The article distinguishes treaty obligations from persuasive guidance and interview perceptions from established legal findings. It recommends targeted amendments, clearer procedures, and compatible records, assigning each reform to the legal instrument that can authorise it.
