Abstract

ABSTRACT
Land reform has been an important instrument of social justice in Tamil Nadu, particularly in improving the position of landless agricultural labourers and economically weaker rural occupants. The Tamil Nadu Occupants of Kudiyiruppu (Conferment of Ownership) Act, 1971 represents an important welfare-oriented legislative measure that provides a statutory mechanism for the vesting and conferment of ownership rights in respect of Kudiyiruppu sites upon eligible occupants, subject to the statutory requirements of the Act.This paper examines the historical background, legislative purpose, statutory framework and legal significance of the Act within the broader framework of land reform in Tamil Nadu. The study focuses on the central transformation from residential occupation to legally recognised ownership and analyses how the legislation contributes to residential security, social welfare and social justice among eligible rural occupants. The research adopts a qualitative doctrinal and analytical methodology based primarily on statutory provisions, judicial decisions and relevant legal literature. The study finds that the Act occupies an important position in Tamil Nadu’s land reform framework by recognising that land reform is not limited to agricultural land, tenancy reforms and ceiling legislation, but also includes the security of residential occupation. The paper further finds that the effective achievement of the Act’s objectives depends upon proper identification of eligible beneficiaries, lawful determination of claims and efficient implementation by the competent authorities. It concludes that the Act remains an important example of welfare-oriented land reform legislation that promotes residential security and legally recognised ownership rights while advancing the broader objectives of social justice.
