Abstract

Environmental Impact Assessment (EIA) is intended to identify potential environmental harm before a project begins and to help decision-makers determine whether the project should proceed and under what conditions. India’s framework, principally under the Environment (Protection) Act, 1986, and the EIA Notification, 2006, provides for prior environmental clearance, expert appraisal, public consultation, and compliance monitoring. Yet the existence of these procedures does not, by itself, ensure that environmental risks are identified or controlled. This article argues that accountability is often lost as information moves from the EIA report to public consultation, appraisal, clearance conditions, and monitoring. Drawing on legislation, audit findings, published studies, judicial decisions, and selected project examples, it develops a continuity-of-accountability approach: the risks identified at one stage must remain visible and actionable at every subsequent stage. It then considers how geospatial tools and climate assessment can improve this process and proposes reforms designed to connect evidence with reasoned decisions, enforceable conditions, and verified compliance.
