Abstract

Gender equality in the workplace is both a fundamental human right and an essential condition for inclusive economic development. Although employment laws across many jurisdictions formally prohibit discrimination on the ground of sex, the persistence of unequal pay, occupational segregation, under-representation of women in leadership, workplace harassment, and unequal caregiving responsibilities demonstrates that legal recognition alone is insufficient. This paper examines the relationship between employment law and gender equality in the workplace. It analyses the constitutional and statutory framework governing employment discrimination, equal remuneration, maternity and parental benefits, and protection against sexual harassment. The paper also considers international labour standards, particularly those developed under the International Labour Organization and the Convention on the Elimination of All Forms of Discrimination against Women. It argues that gender inequality in employment is produced not only by discriminatory laws but also by weak enforcement, social expectations, workplace culture, and the unequal distribution of unpaid care work. The study concludes that effective gender equality requires a combination of strong legislation, accessible complaint mechanisms, transparent pay practices, gender-sensitive workplace policies, and shared responsibility for care between employers, the state, and families.
