Abstract

ABSTRACT

Deepfake technology has exploded over the past few years, driven by AI and machine learning resources. It’s become possible to generate audio, images and videos that look and sound real but are totally fabricated. There are a lot of good things to do with this like entertainment, creative projects or new ways of communicating online. But deepfakes have also been used in some deeply disturbing ways. Creating content without someone’s permission by using their face or body in pornographic scenes and they don't even know about it. This can ruin a person’s reputation. Really hurt their mental health. It also invades their privacy in ways that're hard to fix.

It delves into what happens when people consent to a deepfake and what happens when they don’t. Non-consensual deepfakes often fit the profile of a sexual offense, online harassment or so-called image-based sexual abuse. Indian criminal and cyber laws already cover things like obscenity, harassment and privacy but none of them specifically address deepfakes. There is simply too much gray area.
