DEEPFAKES AND CRIMINAL LIABILITY IN INDIA: A CONSTITUTIONAL AND CRIMINAL LAW ANALYSIS

Abstract

Deepfake technology has quickly raised concerns with regard to criminal law, fundamental rights and regulation in India. While there might be some legitimate purposes for which the technology can be employed, such as artistic purposes, parodies, journalistic reporting, access and entertainment, any abuse of such technology can cause harm with regard to privacy, dignity, reputation, property, public order, and individual autonomy. This paper seeks to explore whether the Indian legal system will have sufficient legal tools to respond to the harms without unduly impinging upon constitutionally protected expression. It will discuss constitutional issues of deepfakes based on that the Article 14, 15, 19(1)(a), 19(2), and 21 on privacy, dignity, reputation, equality and proportionality. We will be looking at the use and restrictions of various legislation such as Bharatiya Nyaya Sanhita, 2023, Information Technology Act, 2000, the Protection of Children from Sexual Offences Act, 2012, Digital Personal Data Protection Act, 2023 and amendments about intermediaries. This research will analyse the differences in legislation on deepfakes in the EU, the USA, and China, and other legislative methods. Any attempts to deceive by creating a fake identity or character will be treated as a crime, with appropriate punishments, ways to prove it, and a process for victim redress.
