CONCEPT OF DOMICILE UNDER PRIVATE INTERNATIONAL LAW: AN OVERVIEW

Abstract

ABSTRACT:
In private international law, particularly in common law systems, domicile is one of the keys connecting elements. It links a person to a certain legal system (lex domicilii) in order to settle choice-of-law disputes pertaining to succession, family law, legal capacity, and personal status. Domicile relies on both physical presence and the intention to stay permanently (animus manendi), in contrast to nationality, which is solely political.
This paper examines how the three conventional types of domiciles—origin, choice, and dependence—have evolved from strict common law principles (such as the revival doctrine) to contemporary statutory revisions. The high legal threshold for leaving one's place of origin, dealing with individuals who have several residences, and the continuous conflict between common law domicile and civil law.
