BALANCING PRIVATE RIGHTS AND PUBLIC INTERESTS: A CONSTITUTIONAL AND LEGAL ANALYSIS

Abstract

The relationship between private rights and public interests is a fundamental concern in constitutional law and legislative policy. Private rights protect individual liberty, privacy, dignity, property and personal autonomy, while public interests promote collective welfare, public order, national security, environmental protection and social justice. Conflicts arise when the exercise of individual rights affects the welfare of society or when State measures intended to protect public interests restrict individual freedoms. In a constitutional democracy such as India, balancing these competing interests requires a careful examination of constitutional principles, legislative objectives and judicial safeguards. This article examines the constitutional framework governing private rights and public interests, with particular reference to Articles 14, 19 and 21 of the Constitution of India. It analyses the role of the legislature in formulating public welfare policies and the judiciary in reviewing restrictions imposed on individual rights. The article also explores the principle of proportionality as an important tool for determining whether restrictions on private rights are justified by legitimate public objectives. It argues that public interest should not serve as an unrestricted justification for State interference, nor should private rights be treated as absolute in every circumstance. The study concludes that a fair balance requires reasonableness, necessity, proportionality, transparency and effective judicial review to ensure that individual liberty and collective welfare coexist within the constitutional framework.
