Alternative Dispute Resolution (ADR) has emerged as a
cornerstone of modern jurisprudence, offering an efficient, cost-effective, and
flexible alternative to traditional litigation. This paper provides a
comprehensive overview of the four primary pillars of ADR: Arbitration,
Mediation, Conciliation, and Negotiation. It explores their structural
methodologies, legal frameworks, and procedural nuances. Despite their growing
adoption globally, these mechanisms face distinct contemporary challenges,
including shifting regulatory landscapes, technological disruptions, and
enforcement inconsistencies. This paper analyzes these systemic hurdles and
offers targeted recommendations to enhance the efficacy of ADR, concluding that
an integrated, tech-driven, and structurally robust ADR ecosystem is vital for
the future of global dispute resolution.
