Abstract

ABSTRACT
This research paper critically examines the constitutional and legal framework governing the freedom of association and trade union rights of government servants in India. It focuses on the interpretation of Article 19(1)(c) of the Constitution, the operation of service conduct restrictions, and the judicial approach to collective rights in public employment. The study argues that although Indian constitutional law recognizes the right of government servants to form associations or unions, it does not extend this protection to a fundamental right to strike. Through an analysis of constitutional provisions, landmark judicial decisions, and service law principles, the paper highlights the continuing tension between the demands of public administration and the autonomy of government employees. It further strengthens the discussion through a comparative study of the legal position in the United Kingdom, South Africa, and Canada, thereby showing how different constitutional systems balance collective labour rights with administrative discipline.
