Abstract

A woman can now be represented in sexually explicit images created with AI if only one of her images is available. This paper looks into the responses of Indian Law towards deepfakes and non-consensual intimate imagery. It asserts that the current system, which is made up of Bharatiya Nyaya Sanhita (2023), the Information Technology Act (2000), the Digital Personal Data Protection Act (2023), and the intermediary rules in 2026, is underpinned by three faulty presumptions: that the offending image depicts a real incident, that the problem is that of obscenity as opposed to consent’s absence, and that harm occurs if people believe the image. In a doctrinal and comparative analysis, the paper uses a rights-based approach based on Puttaswamy on privacy and dignity and outlines the shortcomings of the current law, and what changes need to be made.
