Constructive Res Judicata

Direct Application: Res judicata applies directly to
matters that have been adjudicated in a previous lawsuit between the same
parties.

Extended Application: Constructive res judicata, as
explained in Explanation IV of Section 11 of the Code of Civil Procedure,
1908, extends the principle to issues that could and should have been raised
in the earlier proceeding.

Preclusion: It bars the re-litigation of
issues that were actually decided in the earlier proceeding.
