Abstract

The rapid adoption of generative artificial intelligence in legal research has brought with it a new and serious risk: the production of ‘hallucinated’ authorities, that is, case citations, quotations and legal propositions that appear authentic but do not exist. This study examines that risk in the Indian context through the decision of the Supreme Court of India in Pooja Ramesh Singh v Jammu and Kashmir Bank Ltd, in which the orders of the National Company Law Tribunal and the National Company Law Appellate Tribunal were set aside because they relied on fabricated or misattributed precedents. Using a doctrinal methodology, the paper explains the nature of legal research, the sources of law and the doctrine of judicial precedent under Article 141 of the Constitution of India, and then considers why generative AI systems produce false legal information. It evaluates the White Paper on Artificial Intelligence and Judiciary issued by the Supreme Court of India, the Draft Regulations for Use of Artificial Intelligence (AI) in Courts, 2026, the duties of advocates and judges to verify legal authorities, and the existing statutory framework that touches on AI in India. The paper argues that AI must be treated as an aid to legal research and never as a source of law, and that responsibility for accuracy remains with the advocate and the court. It concludes with recommendations on compulsory verification of authorities, professional guidelines, human supervision, training, confidentiality and accountability.
